In signing this foster care agreement, you are agreeing to follow the rules and procedures established by Perry Animal Welfare Society, which include: 1. All foster animals are the property of Perry Animal Welfare Society and will be returned to Perry Animal Welfare Society when requested. 2. The foster will not represent themselves as anything other than a foster or volunteer of Perry Animal Welfare Society. Any other representation to any individual group and/or organization will only be made at the consent of the management of Perry Animal Welfare Society. 3. All veterinary services will be pre-approved by your Perry Animal Welfare Society contact or their designee. Any unauthorized charges for medical care and services will be the liability of the foster and may not be reimbursed. 4. Foster will make every attempt to participate in special events and accompany the animal to facilitate adoption. 5. The foster will make their best effort to make arrangements with potential adopters to meet their foster animal at an agreed upon location and time as soon as possible upon request. 6. The foster will notify Perry Animal Welfare Society of needs such as food, toys, bedding, crates, etc. Purchases made by the foster without advance approval by your PAWS contact or designee, may not be reimbursed. 7. The foster is fully aware of the risks that the animal(s) they may interact with pose, has elected to interact with the animal(s) voluntarily, and agrees to hold harmless Perry Animal Welfare Society, it’s agents and members for any and all damages, illness, or injury caused due to or directly by the animal in their custody. 8. I will allow Perry Animal Welfare Society to use my name, image, voice, words, or likeness in photo(s), video, or written text in educational and promotional material. I waive any rights of privacy and/or publicity I may have in connection therewith. 9. In the event it is determined by either a Perry Animal Welfare Society representative or the foster that the dog should not remain with the foster, it is agreed the dog shall be returned to Perry Animal Welfare Society (or it’s appointed agent) by the foster. The dog may not be transferred to another person without the express written consent of Perry Animal Welfare Society. If euthanasia becomes necessary, it is agreed this will be performed by a licensed veterinarian, and that the dog will not be turned over to a Humane Society or Animal Shelter for this service. Perry Animal Welfare Society is available for consultation, advice and assistance in this and all other areas pertaining to the health, training, compatibility etc. of the fostered dog. It is expressly understood and agreed that the dog remains the property of Perry Animal Welfare Society at all times, and that the dog shall be returned to Perry Animal Welfare Society (or it’s appointed agent) by the foster upon Perry Animal Welfare Society’s written notice to the foster at the residence of the dog. 10. The foster agrees to not violate any laws or ordinances with the dog. 11. It is agreed and understood by the foster and Perry Animal Welfare Society that this written agreement sets forth all promises, agreement, conditions, and understanding between them, oral or written, and that both parties have fully read and understand all of the agreement. 12. This agreement shall inure to the benefit of and be binding upon the foster and Perry Animal Welfare Society and their successors or beneficiaries. 13. In the event this contract, including all its covenants and conditions are breached by the foster it is agreed the foster shall pay $150.00 as damages. This amount is the best estimate by Perry Animal Welfare Society as to the costs of a breach of the contract by foster. Payment of these damages shall not excuse the foster from returning the dog to Perry Animal Welfare Society and does not include court costs or attorney's fees as set forth. 14. In the event of the employment of an attorney by Perry Animal Welfare Society on account of any violation of this agreement, it is agreed the foster shall pay Perry Animal Welfare Society’s attorney's fees and court costs as may be reasonably necessary. 15. In the event of any dispute concerning the possession, ownership, or welfare of the dog, the foster expressly acknowledges and agrees: (a) that the dog is a unique and irreplaceable item of property belonging to Perry Animal Welfare Society, (b) that monetary damages cannot fully compensate Perry Animal Welfare Society for the loss of possession or control over the dog, (c) that irreparable harm will ensue to Perry Animal Welfare Society or to Perry Animal Welfare Society’s property unless the dog is immediately returned to Perry Animal Welfare Society, (d) that Perry Animal Welfare Society has no adequate remedy at law other than immediate recovery of the dog by prejudgment attachment or replevin, and, (e) that Perry Animal Welfare Society shall be entitled to pre-judgment attachment or replevin to recover possession of the dog under this agreement without posting of any bond or security, and without prior notice to the foster or hearing.
